Terms of Service

1. Introduction
These Terms of Service ("Terms") govern your access to and use of the Aigency platform ("Service"), operated by Aigency, based in Johannesburg, South Africa. By creating an account or using the Service, you agree to be bound by these Terms.
If you do not agree with any part of these Terms, you may not use the Service.
2. Definitions
- "Platform" — The Aigency web application, APIs, AI bots, and all related services accessible at dontthinkabout.com.
- "Workspace" — An isolated tenant environment created for your business within the Platform.
- "User" — Any individual who accesses or uses the Platform, including workspace administrators and team members.
- "Content" — Any data, text, files, messages, or other materials uploaded to or generated within the Platform.
3. Account Creation
3.1. You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your login credentials.
3.2. You must be at least 18 years old to create an account and use the Service.
3.3. Each workspace is administered by the account holder who created it. The workspace administrator is responsible for managing team member access and permissions.
3.4. You are responsible for all activity that occurs under your account and within your workspace.
4. Free Trial
4.1. New workspaces receive a 14-day free trial with access to limited features.
4.2. During the trial period, certain features may be restricted, including but not limited to: message volume limits, number of linked WhatsApp numbers, and advanced AI capabilities.
4.3. At the end of the trial period, you must subscribe to a paid plan to continue using the Service. If you do not subscribe, your workspace will be deactivated. Your data will be retained for 30 days, after which it may be permanently deleted.
4.4. We reserve the right to modify, suspend, or discontinue the free trial at any time without prior notice.
5. Subscription & Billing
5.1. Paid subscriptions are billed monthly or annually, as selected at the time of purchase.
5.2. All payments are processed securely through PayFast, a PCI DSS-compliant South African payment gateway. We do not store your credit card or bank account details.
5.3. Prices are quoted in South African Rand (ZAR) and are inclusive of VAT where applicable.
5.4. Subscriptions renew automatically at the end of each billing cycle unless cancelled before the renewal date.
5.5. Refunds are handled on a case-by-case basis. Contact us at talk@dontthinkabout.com for refund requests.
5.6. We reserve the right to change subscription pricing with 30 days' written notice. Existing subscribers will be notified before any price changes take effect.
6. Acceptable Use
You agree not to use the Service to:
- Violate any applicable law, regulation, or third-party rights
- Send spam, unsolicited messages, or bulk marketing via WhatsApp in violation of WhatsApp's Terms of Service or POPIA
- Upload or transmit malware, viruses, or harmful code
- Attempt to gain unauthorised access to other workspaces, accounts, or systems
- Impersonate any person or entity
- Use the AI bots to generate illegal, harmful, defamatory, or discriminatory content
- Interfere with the operation or security of the Platform
- Reverse engineer, decompile, or disassemble any part of the Platform
- Resell or redistribute the Service without our written consent
We reserve the right to suspend or terminate accounts that violate these terms without prior notice.
7. WhatsApp Bot Usage
7.1. By connecting a WhatsApp number to the Platform, you authorise Aigency to receive, store, and process messages sent to that number.
7.2. Messages received by your linked WhatsApp numbers are processed by artificial intelligence to generate automated responses according to your bot configuration.
7.3. You are responsible for ensuring that your customers and contacts are informed that they are communicating with an AI-powered system where applicable.
7.4. You must comply with WhatsApp's Business Policy, Terms of Service, and Commerce Policy when using the WhatsApp integration.
7.5. Aigency is not responsible for the content of AI-generated responses. You should review and configure your bots carefully and monitor their performance.
8. Data Ownership & Multi-Tenant Isolation
8.1. You own your data. All Content you upload, create, or generate within your workspace remains your property.
8.2. By using the Service, you grant Aigency a limited licence to store, process, and transmit your Content solely for the purpose of providing the Service to you.
8.3. Aigency operates as a multi-tenant platform. Each workspace's data is logically isolated. Users in one workspace cannot access data belonging to another workspace.
8.4. Upon termination of your account, you may request an export of your data. We will provide your data in a standard format within 30 days of the request.
8.5. We do not use your Content to train AI models or for any purpose other than providing the Service to you.
9. Service Availability
9.1. We aim to maintain 99.9% uptime but do not guarantee uninterrupted availability. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.
9.2. We will make reasonable efforts to notify users of planned maintenance in advance.
9.3. We are not liable for any loss or damage arising from service interruptions, including those caused by load shedding, internet outages, or third-party service failures.
10. Intellectual Property
10.1. The Platform, including its design, code, AI models, branding, and documentation, is the intellectual property of Aigency and is protected by South African and international copyright law.
10.2. You may not copy, modify, distribute, or create derivative works based on the Platform without our express written permission.
11. Limitation of Liability
11.1. To the maximum extent permitted by South African law, Aigency shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
11.2. Our total liability for any claim arising from or related to the Service shall not exceed the total amount you paid to us in the 12 months preceding the claim.
11.3. We do not warrant that AI-generated responses will be accurate, complete, or suitable for any particular purpose. You use AI features at your own risk.
11.4. We are not responsible for any decisions made based on AI-generated content or for any loss resulting from reliance on such content.
12. Indemnification
You agree to indemnify and hold harmless Aigency, its directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.
13. Termination
13.1. You may cancel your subscription and close your account at any time by contacting us at talk@dontthinkabout.com.
13.2. We may suspend or terminate your account if you breach these Terms, engage in prohibited conduct, or fail to pay subscription fees.
13.3. Upon termination, your access to the Platform will cease. Your data will be retained for 30 days to allow you to request an export, after which it may be permanently deleted.
13.4. Sections that by their nature should survive termination (including Limitation of Liability, Indemnification, and Governing Law) will survive.
14. Governing Law & Dispute Resolution
14.1. These Terms are governed by the laws of the Republic of South Africa.
14.2. Any disputes arising from these Terms or your use of the Service shall first be addressed through good-faith negotiation between the parties.
14.3. If negotiation fails, disputes shall be submitted to mediation in Johannesburg, South Africa, in accordance with the rules of the Arbitration Foundation of Southern Africa (AFSA).
14.4. If mediation is unsuccessful, either party may submit the dispute to the jurisdiction of the High Court of South Africa, Gauteng Division, Johannesburg.
15. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via email or a notice on the Platform at least 30 days before they take effect. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
